Refund policy
12.1. Conformity Guarantee
Article L.211-4 of the French Consumer Code: “The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation, where these have been made the seller’s responsibility by the contract or carried out under the seller’s responsibility.”
Here are the paragraphs extracted from the General Terms and Conditions of Sale relating to returns and refunds:
12.1. Warranty of conformity
Article L.211-5 of the French Consumer Code: "To be in conformity with the contract, the goods must: 1° Be suitable for the usual purpose of similar goods and, where applicable: correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer as a sample or model;have the qualities that a buyer may legitimately expect in view of public statements made by the seller, the producer, or their representative, particularly in advertising or labeling; 2° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller’s attention and accepted by the seller.
The SELLER is required to deliver a PRODUCT in conformity with the contract, meaning it must be suitable for the expected use of similar goods and correspond to the description provided on the WEBSITE. This also implies that the PRODUCT must possess the qualities a buyer may legitimately expect based on the public statements made by the SELLER, including in advertising and labeling. In this context, the SELLER may be held liable for conformity defects existing at the time of delivery and for those resulting from packaging, assembly instructions, or installation when these have been the seller’s responsibility or carried out under the seller’s responsibility. The legal action for lack of conformity must be brought within two (2) years from the delivery of the PRODUCT. (Article L.211-12 of the French Consumer Code) In the event of a lack of conformity, the CLIENT may choose to have the PRODUCT replaced or repaired. However, if the CLIENT’s choice involves a cost that is clearly disproportionate compared to the alternative, given the value of the PRODUCT or the significance of the defect, the SELLER may proceed with a refund instead of the option chosen by the CLIENT. If replacement or repair is not possible, the SELLER agrees to refund the price of the PRODUCT within 30 days of receiving the returned PRODUCT and upon return of the PRODUCT by the CLIENT. Lastly, the CLIENT is not required to provide proof of the existence of the lack of conformity of the PRODUCT.
